Terms of Service

These Terms of Service ("Terms") govern your access to and use of the games, apps, websites, accounts, authentication, leaderboards, multiplayer, FuzzyCastle Pass, and related services provided by FuzzyCastle LLC (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and accounts

You must be at least 13 years old, or the higher minimum age required where you live, to use an account-based Service. If you are under the age of legal majority, you represent that a parent or guardian has authorized your use. You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized access. Accounts and access tokens are personal and may not be sold, transferred, or publicly shared.

Acceptable use

You may use the Services for lawful personal entertainment. You may not:

• cheat, manipulate scores, exploit defects, automate play, or evade security or usage controls;
• disrupt the Services, other players, authentication, multiplayer, billing, or infrastructure;
• access another account without authorization or share credentials in a way that defeats account restrictions;
• upload malicious, unlawful, infringing, deceptive, abusive, or harassing material;
• copy, redistribute, scrape, reverse engineer, or commercially exploit the Services except where applicable law expressly permits it; or
• use game themes involving cards, poker, or chance for real-money gambling. FuzzyCastle games do not award money or items redeemable for money unless a separate offering expressly states otherwise and is lawfully provided.

Games, scores, and multiplayer

Scores and rankings may be validated, rejected, corrected, reset, archived, or removed to address cheating, defects, seasonal changes, maintenance, or service integrity. Multiplayer rooms and matches may close because of inactivity, capacity, maintenance, disconnection, or rule enforcement. We do not guarantee that a particular score, ranking, room, match, game state, or saved item will remain available indefinitely.

FuzzyCastle Pass and purchases

Purchases and subscriptions are subject to the terms shown at checkout and the FuzzyCastle Pass Terms. Store-distributed purchases may also be governed by the applicable platform's billing and refund rules. You authorize the displayed charge when you complete a purchase. Taxes may apply where required.

Intellectual property

The Services, including their software, games, artwork, audio, characters, text, designs, trademarks, and other content, are owned by FuzzyCastle LLC or its licensors and protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No ownership rights are transferred to you.

User-provided material

If a Service lets you submit content, you retain any rights you hold in it and grant FuzzyCastle a worldwide, non-exclusive license to host, reproduce, modify, display, and distribute that content as reasonably necessary to operate, secure, improve, and present the Service. You represent that you have the necessary rights and that the material complies with these Terms.

Service changes and availability

We may add, change, suspend, or discontinue features or Services. We aim to provide reliable access but do not promise uninterrupted, secure, or error-free operation. Updates, maintenance, capacity limits, provider failures, and events beyond our control may affect availability.

Suspension and termination

We may limit, suspend, or terminate access when reasonably necessary to protect users or the Services, investigate suspected violations, comply with law, address nonpayment, or enforce these Terms. You may stop using the Services and may delete your account through the provided deletion process. Provisions that by their nature should survive termination will remain in effect.

Disclaimers and limitation of liability

To the extent permitted by law, the Services are provided "as is" and "as available" without warranties of uninterrupted availability, merchantability, fitness for a particular purpose, or non-infringement. To the extent permitted by law, FuzzyCastle LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or opportunity arising from the Services. Nothing in these Terms excludes rights or liability that applicable law does not allow us to exclude.

Governing terms and disputes

These Terms are governed by applicable United States law and the law of the state where FuzzyCastle LLC is organized, without overriding mandatory consumer protections that apply where you live. Before filing a formal claim, please contact us and give both sides a reasonable opportunity to resolve the issue informally.

Privacy, changes, and contact

Our Privacy Policy explains how we process information. We may update these Terms as the Services change. If a change materially affects existing users, we will provide notice where reasonably required. The effective date above identifies the current version.
